Sunrise Senior Living's former chief financial officer is firing back over his ouster from the senior housing giant. Bradley Rush has filed suit for breach of contract and defamation in Fairfax Circuit Court, claiming he was wrongly discharged in May 2007 after discovering accounting problems. The Virginia Supreme Court has affirmed a Fairfax County Judge's decision to sanction a lawyer for asserting defenses to an injury case that the lawyer knew were not supported by fact. The lawyer was sanctioned $2000 to cover the cost the plaintiff incurred fighting the frivolous defenses. The case is Ford Motor Company, et al. v. Berta Benitez, 639 S.E.2d 203 (2007). Plaintiff lawyers applauded the decision. "It should make litigation fairer and less expensive. The tort reform lobby blames plaintiff lawyers for high insurance rates. It is ironic, because insurance companies and corporations have routinely created needless litigation expenses by fighting legitimate lawsuits with frivolous defenses."
